These Terms of Use ("Terms") govern your access to and use of nmvexpedition.com (the "Site"), operated by NMV Expedition Inc. ("NMV Expedition," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Who We Are

NMV Expedition Inc. is a licensed motor carrier (USDOT# 3174879, MC# 122053) located at 10020 Industrial Drive, Pineville, NC 28134.

2. Use of the Site

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for lawful, personal, and business purposes. You agree not to:

• Use the Site in any way that violates applicable law or regulation;
• Submit false, misleading, or fraudulent information through any form on the Site;
• Attempt to gain unauthorized access to any portion of the Site, its servers, or any connected systems;
• Use automated means (bots, scrapers) to access the Site or collect information from it, other than standard search-engine indexing;
• Introduce viruses, malware, or other harmful code;
• Interfere with or disrupt the operation of the Site.

3. Quotes and Service Information

Information on the Site about our services, coverage, capacity, facility, and pricing is provided for general information only. Any rate or quote provided through or in response to the Site is an estimate only and is not binding until confirmed by NMV Expedition in a rate confirmation or other written agreement. All transportation, warehousing, and related services we provide are governed exclusively by the applicable bill of lading, rate confirmation, warehouse receipt, or other written contract between you and NMV Expedition, and by applicable federal and state transportation law. In the event of any conflict between the Site and such an agreement, the agreement controls. Nothing on this Site creates a contract of carriage, a bailment, or any other service obligation.

4. Driver Applications

If you submit a driver application through the Site, you represent that all information you provide is true, accurate, and complete. Submitting an application does not create an offer of employment, an employment contract, or any obligation on our part to contact or hire you. Any employment with NMV Expedition would be at-will unless otherwise agreed in writing. As a regulated motor carrier, we are required to verify qualifications, employment history, and driving records in accordance with U.S. Department of Transportation and FMCSA regulations; by applying, you acknowledge that hiring is conditioned on satisfying those requirements. Falsified application information is grounds for refusal or termination of employment.

5. Intellectual Property

The Site and all content on it, including text, graphics, logos, images, and design, are the property of NMV Expedition Inc. or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except for personal, non-commercial viewing.

6. Submissions

When you submit information through the Site (such as a quote request, message, or application), you grant us the right to use that information to respond to you and operate our business, as described in our Privacy Policy. You are responsible for the accuracy of what you submit.

7. Third-Party Websites

The Site may link to or embed third-party websites and services (for example, maps). We do not control and are not responsible for third-party content, and linking does not imply endorsement. Your use of third-party services is at your own risk and subject to their terms.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. THIS SECTION DOES NOT LIMIT ANY WARRANTY OR OBLIGATION CONTAINED IN A SEPARATE WRITTEN SERVICE AGREEMENT BETWEEN YOU AND NMV EXPEDITION, AND DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, INCLUDING LIABILITY OF A MOTOR CARRIER UNDER FEDERAL TRANSPORTATION LAW FOR CARGO IN ITS CARE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NMV EXPEDITION AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THIS SECTION APPLIES ONLY TO USE OF THE SITE ITSELF; LIABILITY RELATING TO TRANSPORTATION OR WAREHOUSING SERVICES IS GOVERNED BY THE APPLICABLE SERVICE AGREEMENT, BILL OF LADING, AND APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless NMV Expedition and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party in connection with your use of the Site.

11. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules, except to the extent federal law applies. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction and venue there. Nothing in this section changes the governing law or venue provisions of any separate service agreement.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

13. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms and the Privacy Policy are the entire agreement between you and NMV Expedition regarding use of the Site, and supersede any prior understandings on that subject. Our failure to enforce any provision is not a waiver of it.
